This Compliance & Legal Disclaimer ("Disclaimer") explains the scope, limitations, and legal responsibilities associated with the use of the Tenanting platform ("the Platform", "we", "us"), operated by Tenanting Technologies Pvt Ltd.
By accessing or using Tenanting, you acknowledge and agree that the Platform is a technology solution designed to assist property owners and tenants with onboarding, verification workflows, rent and lease management, and record-keeping — and that it does not replace your legal, regulatory, or professional obligations under Indian law.
This Disclaimer should be read together with our Privacy Policy and Terms of Service.
Platform Role & Scope
Tenanting is a digital tenant and property management platform that provides tools to facilitate:
- Tenant onboarding, KYC data collection, and document submission
- Structured verification workflows (identity, address, employment)
- Digital lease agreement generation and e-signature facilitation
- Rent scheduling, payment tracking, and digital receipt generation
- Issue, maintenance, and appliance/document record-keeping
- Status tracking, approvals, reminders, and audit trails
Tenanting does not act as a real estate agent, broker, guarantor, surety, legal advisor, chartered accountant, notary, registering authority, or law enforcement body. Tenanting does not draft agreements as a licensed legal professional, conduct police verification on behalf of any government authority, or certify the legal validity of any tenancy.
No Legal, Tax, or Regulatory Advice
Information, templates, workflows, status indicators, or AI-generated content (including lease agreements generated via the Platform's agreement-generation feature) made available on the Platform are provided for general informational and operational convenience only. They do not constitute legal, tax, regulatory, or other professional advice, and should not be relied upon as a substitute for advice from a qualified advocate, chartered accountant, or relevant government authority.
AI-generated lease agreements are produced from owner- and tenant-supplied information and standard clause libraries.
Owner Responsibilities
Property owners using Tenanting remain solely responsible for:
- Complying with all applicable central, state, and local laws governing rental tenancies, including the Model Tenancy Act 2021 (where adopted by the relevant state), state-specific Rent Control Acts, and the Registration Act, 1908
- Initiating and completing police verification of tenants and complying with local police/municipal authority requirements, where mandated
- Ensuring rental agreements are properly stamped and, where legally required, registered with the appropriate sub-registrar
- Independently reviewing and executing rental agreements, including any agreement generated through the Platform
- Determining and remitting applicable taxes, including GST on commercial tenancies and any TDS obligations arising under the Income Tax Act, 1961
- Ensuring the lawful collection, use, and handling of tenant personal data in accordance with the Digital Personal Data Protection Act, 2023
- Resolving disputes with tenants directly or through appropriate legal or arbitration channels
Tenanting provides tools and workflows to assist these processes but does not assume responsibility for compliance outcomes, regulatory filings, or the legal enforceability of any agreement.
Tenant Responsibilities
Tenants using Tenanting are responsible for:
- Providing accurate, current, and truthful information and documentation during onboarding and KYC
- Submitting valid, lawful, and unaltered identity, address, and supporting documents
- Complying with the terms of their executed rental agreement and applicable law
- Cooperating with police verification and other statutory requirements where applicable
- Independently reviewing any lease agreement before signing, including AI-generated agreements, and seeking independent advice where needed
Verification & Background Checks
Identity, address, employment, and other verification indicators displayed on the Platform are based on information and documents submitted by users, or obtained from third-party verification service providers integrated with the Platform. Verification outcomes reflect the data available at the time of the check.
Tenanting does not independently investigate, audit, or guarantee the accuracy, completeness, authenticity, or currency of such information unless expressly stated as a Tenanting-verified outcome for a specific feature. Owners should exercise independent judgment, particularly for police verification, criminal background checks, and any verification step not yet fully supported on the Platform.
Digital Signatures & Agreement Validity
Where the Platform facilitates electronic signing of lease agreements, such signatures are intended to be consistent with the recognition of electronic signatures under Sections 5 and 65B of the Information Technology Act, 2000. Legal validity, evidentiary weight, and enforceability of any agreement nonetheless depend on the specific facts of the tenancy, applicable state stamp duty rules, and registration requirements.
Tenanting does not guarantee that any agreement generated, signed, or stored through the Platform satisfies the registration or stamping requirements of a particular state, or that it will be accepted as-is by any sub-registrar, court, or government authority. Owners are responsible for completing stamping and registration through the appropriate official channels where legally required.
Rent Collection & Payment Processing
Tenanting facilitates rent tracking, reminders, and digital receipt generation. Where payment collection or processing is enabled through the Platform, such payments are processed via integrated third-party payment gateways. Tenanting does not act as a banking or payment institution, does not hold tenant or owner funds in escrow beyond what is required for transaction processing by the relevant payment gateway, and is not responsible for delays, reversals, or failures caused by banks, payment gateways, or the Reserve Bank of India's payment infrastructure.
Limitation of Liability
To the maximum extent permitted by applicable law, Tenanting, its directors, employees, and affiliates shall not be liable for:
- Decisions made by owners or tenants based on data, status indicators, or AI-generated content available on the Platform
- Disputes, losses, or damages arising between owners and tenants, including disputes over deposits, damages, or agreement terms
- Losses arising from inaccurate, incomplete, or fraudulent information submitted by any user
- Regulatory or legal non-compliance by owners or tenants, including failure to complete police verification, stamping, or registration
- Delays, errors, or failures originating from third-party verification, payment, communication, or infrastructure providers
- Indirect, incidental, or consequential losses arising from use of the Platform
Nothing in this Disclaimer excludes or limits liability that cannot be excluded or limited under applicable Indian law, including the Consumer Protection Act, 2019.
Third-Party Services & Integrations
The Platform integrates with third-party service providers for identity verification, payment processing, communication (including email and WhatsApp Business API providers), cloud storage, and AI-assisted document generation. Tenanting selects these providers with reasonable care but is not responsible for their availability, accuracy, security practices, or conduct, which are governed by their own respective terms and policies.
Regulatory Changes
Laws and regulations governing rental tenancies, data protection, electronic signatures, and payments in India may change over time, including amendments to the Model Tenancy Act 2021 framework as adopted by individual states, the DPDP Act and its rules, and tax legislation. Tenanting endeavours to keep Platform features aligned with applicable law but does not guarantee that all features automatically and immediately reflect every regulatory change. Users should independently verify current legal requirements for their specific tenancy and jurisdiction.
Data Protection & Privacy
Tenanting processes personal data, including tenant KYC information, in accordance with the Digital Personal Data Protection Act, 2023 and our Privacy Policy. Our data handling practices are built on the principles of consent, purpose limitation, and data minimisation:
- Personal data is collected only for the stated purpose of tenant verification, lease management, and related platform functions, with consent captured at the point of collection
- Sensitive identifiers such as Aadhaar numbers are stored encrypted and displayed in masked form (e.g. XXXX XXXX 1234) after verification
- Access to tenant data is restricted to the relevant property owner, authorised collaborators, and Platform systems necessary to deliver the service
- Data subjects (owners and tenants) may exercise applicable rights of access, correction, and erasure under the DPDP Act by contacting us as described in our Privacy Policy, subject to statutory retention requirements (including financial record-keeping obligations under the Income Tax Act, 1961)
This Disclaimer does not limit or override the rights and obligations described in the Privacy Policy; in the event of any conflict specific to data protection matters, the Privacy Policy shall govern.
No Endorsement or Guarantee
The presence of a property, owner, or tenant on the Platform, or the completion of any onboarding, verification, or status step, does not imply endorsement, approval, certification, or guarantee by Tenanting of that user, property, transaction, or agreement.
Indemnity
Users agree to indemnify and hold Tenanting harmless from claims, losses, or liabilities arising from their breach of applicable law, breach of this Disclaimer, or misuse of the Platform, including the submission of false or fraudulent information.
Governing Law & Jurisdiction
This Disclaimer is governed by the laws of India. Subject to the dispute resolution and jurisdiction provisions of our Terms of Service, courts at Hyderabad, Telangana shall have exclusive jurisdiction over any disputes arising from this Disclaimer.
Updates to this Disclaimer
This Disclaimer may be updated periodically to reflect changes in the Platform, applicable law (including amendments to the DPDP Act, Model Tenancy Act adoption by states, or tax law), or our operational practices. Material changes will be reflected by updating the "Last updated" date below. Continued use of the Platform after such updates constitutes acceptance of the revised Disclaimer.
